These Terms govern your use of CursorBrush (the "App"), a macOS screen annotation tool distributed through the Apple Mac App Store. By downloading, installing, or using the App you agree to these Terms.
1. License
CursorBrush is licensed to you, not sold. Apple's Standard EULA applies in addition to these Terms; in case of conflict, these Terms prevail for non-Apple provisions.
Under the Free tier you may use the App on Macs you own or control. Pro and Ultra upgrades are one-time, non-consumable In-App Purchases tied to your Apple ID.
2. In-App Purchases
- One-time purchase, no subscription. Pro ($5.99) and Ultra ($14.99) are non-recurring. You pay once.
- All payments are processed by Apple. We never receive your payment details.
- Refunds are handled by Apple per their refund policy. We have no ability to issue refunds directly.
- Family Sharing is disabled for V1 In-App Purchases. Each purchase is tied to the Apple ID that buys it.
3. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code beyond what is allowed by applicable law.
- Use the App to violate any law or to infringe third-party rights.
- Distribute, sublicense, or resell the App or your IAP entitlements.
- Bypass the In-App Purchase mechanism (e.g. by patching binaries) to access Pro/Ultra features without payment.
4. Permissions and your data
The App requests Accessibility and Apple Events permissions strictly to provide its core functionality (global shortcuts and Keynote/PowerPoint integration). We do not collect, transmit, or sell any personal data. See our Privacy Policy for details.
5. Updates
We may release updates that fix bugs, add features, or adjust behavior. Updates are delivered through the Mac App Store and require your acceptance. We may discontinue minor features that are no longer maintainable, with reasonable in-app notice.
6. Warranty disclaimer
The App is provided "as is" and "as available" without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterruptible, error-free, or compatible with every macOS version or third-party app (such as Keynote, PowerPoint, Zoom, Teams, or Meet).
7. Limitation of liability
To the maximum extent permitted by law, the App's authors are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising from your use of the App. Aggregate liability for direct damages is limited to the amount you paid for the App in the twelve months preceding the claim (which for many users is zero, since the App is free to download).
8. Apple's third-party beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
9. Termination
Your license terminates automatically if you breach these Terms. Upon termination, you must delete the App from your devices. Sections 4–8 survive termination.
10. Changes to these Terms
We may revise these Terms occasionally. Material changes will be communicated through release notes and a bumped "Last updated" date. Continued use of the App after a change constitutes acceptance of the revised Terms.
11. Governing law and disputes
These Terms are governed by the laws of the Republic of Korea, without regard to its conflict-of-laws provisions, except where superseded by mandatory consumer-protection law of your country of residence. Disputes shall first be attempted to be resolved informally by contacting us at the support address below.
